1. Eligibility
Membership and Use of Next Day Pets Service is void where prohibited. By using NextDayPets.com Services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 18 years of age or older; and (d) your use of the NextDayPets.com Services does not violate any applicable law or regulation. Your profile may be deleted and your Membership may be terminated without warning if we believe that you are less than 18 years of age.

3. Official Rules
 By participating in the Prize Drawing, entrant fully and unconditionally agrees to and accepts these Rules and the decisions of the Sponsor, Judges and/or Administrator, which are final and binding in all matters related to the Prize Drawing. Whether an entrant receives a prize is contingent upon fulfilling all requirements set forth herein.

4. Timing
 The Prize Drawing begins on at 12:00 a.m. Eastern Time ("ET") each first Tuesday of the month and ends at 12:00 p.m. ET each first Monday of the month (the " Prize Drawing Period"). The winner will be chosen through a random drawing which will take place on the first Monday of each month, or in the event of a holiday, on the first business day following that Monday. The winner will be notified of their prize by email each first Monday of each month (or, in the event of a holiday, the first business day following that Monday) or the following day and must verify their address to receive the coupon which will be mailed out within 24 hours of verification.  Next Day Pets' computer is the official time-keeping device for the Prize Drawing.

5. How to Enter
Visit and register at www.NextDayPets.com. (the "Website"). By completing the registration, you agree that your registration conforms to the terms of use and privacy policy as defined on the Website and that Sponsor, in its sole discretion, may decide not to allow your registration or may remove your registration and disqualify you from the Prize Drawing if it believes, in its sole discretion, that your registration fails to conform to these Rules, Policies and Restrictions posted on the website. Each applicant may only register once. Sponsor is not responsible for any changes or effects caused to entrant's computer system as a result of any submission.

CAUTION: ANY ATTEMPT BY ANY ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PRIZE DRAWING MAY BE A VIOLATION OF CRIMINAL OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY THE LAW.

Sponsor will be collecting personal data about participants online, in accordance with its privacy policy. Please review Sponsor's privacy policy at www.NextDayPets.com/privacy.aspx. By participating in the Prize Drawing, entrants agree to Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor's privacy policy.

6. Winner Determination
Winners will be determined by the staff of NextDayPets.com.com the evening of the first Monday of each month or, in the event of a holiday, the first business day following that Monday.

7. Winner Notification
Winners from the outcome of the Winner Determination will be notified by email the evening of the first Monday of each month (or, in the event of a holiday, the first business day following that Monday) or the following day. Each potential winner (parent/legal guardian if winner is a minor in his/her state or residence) will be required to execute and return to Administrator, within four (4) days of the date notice or attempted notice is sent, a Liability & Publicity Release ("Prize Confirmation Docs") in order to claim his/her prize. If a potential winner cannot be contacted, fails to execute and return the Prize Confirmation Docs within the required time period, or prize is returned as undeliverable, potential winner forfeits the  prize. If a potential winner is disqualified for any reason, the entrant whose Entry receives the next highest number of votes will be deemed the potential winner. Only three (3) alternate winners will be selected through this process, after which the applicable prize will remain un-awarded. Acceptance of any prize shall constitute and signify winner's agreement and consent that Sponsor may use, on a perpetual basis, the winner's, name, city, state, likeness, voice, opinions, Entry and/or prize information, for promotional and advertising purposes in any media on a worldwide basis, including on the Internet, without limitation and without further payment or consideration, except where prohibited by law.

9. Release
By receipt of any prize, the applicable winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any losses, damages, rights, claim or cause of action of any kind, including, but not limited to, personal injury, death, or damage to or loss of property, as well as claims based on publicity rights, defamation, and/or invasion of privacy arising, in whole or in part, directly or indirectly out of participation in the Prize Drawing or receipt or use or misuse of any prize.

10. General Conditions
Sponsor reserves the right to cancel, suspend and/or modify the Prize Drawing, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Prize Drawing, as determined by Sponsor in its sole discretion. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Prize Drawing or to be acting in violation of these Rules or those of any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Prize Drawing may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Rules shall not constitute a waiver of that provision.

11. Limitations of Liability
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing errors or by any of the equipment or programming associated with or utilized in the Prize Drawing; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Prize Drawing; (4) technical or human error which may occur in the administration of the Prize Drawing or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Prize Drawing or receipt or use or misuse of any prize. Sponsor is not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor and Administrator are not responsible for any typographical/other error in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Prize Drawing.

12. Disputes
Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Prize Drawing or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Maryland or the appropriate Maryland State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Prize Drawing, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the entrant and Sponsor in connection with the Prize Drawing, shall be governed by, and construed in accordance with, the laws of the State of Maryland without giving effect to any choice of law or conflict of law rules (whether of the State of Maryland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Maryland.
